Welcome to The Party Pop.
This website is operated by The Party Pop Pty Ltd. Throughout this website, the terms “we”, “us” and “our” refer to The Party Pop Pty Ltd.
By visiting our website, placing an order, purchasing a product or otherwise using our services, you agree to be bound by these Terms & Conditions, together with any other policies displayed on our website.
Please read these Terms & Conditions carefully before placing an order.
1. ORDERS & MINIMUM QUANTITIESCertain products sold by The Party Pop are subject to a minimum order quantity.
Where a minimum quantity applies, this will be indicated on the relevant product page. Unless otherwise stated, our minimum order quantity is 5 units per product/design.
Customers requiring quantities outside the options available on our website are welcome to contact us for assistance or a custom quotation.
We reserve the right to refuse or cancel an order where the required minimum quantity has not been met or where an order cannot reasonably be fulfilled.
2. PERSONALIZED PRODUCTSMany of our products are personalized and made specifically for each customer.
It is the customer's responsibility to provide all information required to complete the order, including names, ages, wording, themes, colours, photographs and any other requested personalization details.
Where a photograph is required, please provide a clear, high-resolution image.
The Party Pop cannot be held responsible for poor print quality resulting from a low-resolution, blurred, cropped or otherwise unsuitable photograph supplied by the customer.
3. ARTWORK & APPROVALPersonalised artwork will normally be sent to the customer for approval within 1–2 working days after the order has been placed and payment has been received.
Production of personalised products will only begin once the required artwork has been approved.
Please carefully check all artwork before approving it, including:
• Names
• Ages
• Dates
• Spelling
• Colours
• Photographs
• Logos
• Personalisation details
• Any other information appearing on the designOnce artwork has been approved by the customer, The Party Pop will not be responsible for errors or omissions that were visible on the approved artwork.
Any changes requested after approval may result in additional charges and/or delays.
Proofs and personalised layouts form part of the service provided with your order and will only be prepared once an order has been placed and paid for.
4. ARTWORK & DESIGN RIGHTSUnless otherwise agreed in writing, purchasing a personalised physical product from The Party Pop does not transfer ownership of the digital artwork, design files, templates or production files used to manufacture the product.
Artwork and designs created by The Party Pop may not be copied, edited, reproduced, resold, distributed or used commercially without our written permission.
Where digital artwork files are available for purchase, this will be arranged separately and may be subject to an additional fee and usage conditions.
5. PRODUCTION TIMESOnce personalised artwork has been approved, please allow approximately 3–5 working days for production.
Production times are estimates and may vary depending on:
• Order quantity
• Product type
• Stock availability
• Personalisation requirements
• Current order volumesWe recommend placing your order well in advance of your party or event date.
Working days exclude weekends and South African public holidays.
6. DELIVERYThe Party Pop currently delivers within South Africa only.
Once your order has been completed and dispatched, courier delivery will usually take approximately 2–3 working days, depending on the delivery location and courier service.
Courier delivery times are estimates and are not guaranteed.
Once a parcel has been handed to the courier, delays caused by the courier, severe weather, road closures, strikes, incorrect delivery information or other circumstances outside our reasonable control may affect the delivery date.
Customers are responsible for providing a complete and accurate delivery address and contact information.
Please allow sufficient time for artwork, production and courier delivery when ordering for a specific event date.
7. PACKAGING OF PARTY BOXES & BAGSCertain party boxes, bags and similar products may be dispatched flat to reduce the risk of damage during transport.
Where applicable, the customer may therefore need to assemble the product and/or place the supplied sweets, treats or other fillings into the packaging after delivery.
This does not mean that the product is incomplete; it is a protective shipping measure designed to help ensure that the packaging reaches the customer in good condition.
8. PRODUCT FILLINGS & STOCK AVAILABILITYParty pack fillings, sweets, treats, toys, colours and other included items are subject to supplier and stock availability.
If a listed item becomes unavailable, The Party Pop reserves the right to substitute it with a reasonably similar item of equal or comparable value.
Because supplier packaging and stock change from time to time, the exact brand, colour, flavour, design or appearance of individual filling items may differ from photographs shown on our website.
Where a specific item is essential to your order, please contact us before ordering.
9. PRODUCT IMAGES & COLOURSWe make every reasonable effort to display our products accurately.
However, colours may appear slightly different depending on screen settings, printing processes, materials, lighting and photography.
As many of our products are handmade, printed, cut, assembled or personalised, small variations may occur between products.
These minor variations are part of the nature of personalized and handmade products and do not necessarily constitute a defect.
10. CANCELLATIONSBecause personalized products are made specifically for each customer, cancellation options depend on the stage your order has reached.
If you wish to cancel an order, please contact us as soon as possible.
Where work on a personalized order has already begun, including design or artwork preparation, The Party Pop may retain an amount reasonably related to the work already completed and costs already incurred.
Once artwork has been approved and production has started, cancellation or refund may no longer be possible for personalized or made-to-order products, except where required by applicable law.
Orders that have already been completed or dispatched cannot be cancelled.
11. RETURNS, REFUNDS & PERSONALIZED ITEMSPersonalized, customized and made-to-order products are created specifically according to the information supplied and approved by the customer.
For this reason, these products generally cannot be returned or exchanged merely because the customer has changed their mind, subject always to rights available under applicable South African law.
If you believe you have received an incorrect, defective or damaged product, please contact us as soon as reasonably possible and provide photographs showing the problem.
We will assess the matter and, where appropriate, arrange a suitable remedy in accordance with applicable law and our Returns/Refund Policy.
12. COURIER DAMAGE OR LOST PARCELSWe package orders with reasonable care before handing them to our courier partners.
If your parcel arrives visibly damaged, contains damaged products, or appears to have been lost during delivery, please contact us as soon as possible.
Photographs of the parcel, packaging, shipping label and damaged items may be required so that the matter can be investigated with the courier.
We will assist with legitimate courier claims where reasonably possible.
Nothing in these Terms & Conditions is intended to exclude any rights or remedies that cannot lawfully be excluded.
13. PRODUCT SAFETY & SUPERVISIONCertain Party Pop products may contain sweets, toys, small parts, packaging materials or decorative components.
Children should use products under appropriate adult supervision.
Parents, guardians and responsible adults should consider the age and individual needs of the child before providing any product containing small parts, food items or other components that may not be suitable for them.
Customers are responsible for checking food labels, ingredients and allergen information where applicable before consumption.
14. PRICINGAll prices displayed on our website are subject to change without prior notice.
Where product pricing depends on quantity, filling option, personalisation or another selected option, the final price will be calculated according to the options selected by the customer.
We reserve the right to correct genuine pricing, description or system errors.
If an error affects an order already submitted, we will contact the customer before proceeding where reasonably necessary.
15. ORDER INFORMATIONCustomers agree to provide current, complete and accurate information when placing an order.
This includes:
• Customer name
• Email address
• Contact number
• Billing information
• Delivery address
• Personalisation informationWe will not be responsible for delays or delivery problems resulting from incorrect or incomplete information supplied by the customer.
16. RIGHT TO REFUSE OR CANCEL ORDERSThe Party Pop reserves the right to refuse or cancel an order where reasonably necessary, including where:
• A product is unavailable
• Required materials or stock are unavailable
• Incorrect pricing has been displayed due to a genuine error
• Payment cannot be verified
• We suspect fraudulent activity
• The order breaches these Terms & Conditions
• The requested product or design cannot lawfully or reasonably be producedIf we cancel a paid order before production for reasons attributable to us, any applicable refund will be processed in accordance with our refund obligations.
17. INTELLECTUAL PROPERTYThe Party Pop's website content, original branding, photographs, graphics, layouts, templates and original designs remain the property of their respective rights holders.
Customers may not copy, reproduce, distribute, modify, resell or commercially exploit our original website content or original Party Pop materials without written permission.
Customers who provide photographs, names, logos, graphics or other material for personalisation confirm that they have the necessary permission or rights to provide and use that material for their order.
Nothing in these Terms transfers ownership of third-party trademarks, characters, artwork or other intellectual property to The Party Pop or to the customer.
18. THIRD-PARTY SERVICESOur website and services may rely on third-party providers, including Shopify, payment providers, courier companies and other service providers.
Certain information may be shared with these providers where necessary to process payments, fulfil orders, arrange delivery or provide our services.
Use of personal information is further explained in our Privacy Policy.
19. THIRD-PARTY LINKS & TOOLSOur website may contain links to or integrations with third-party websites, applications or services.
We are not responsible for the content, availability, privacy practices or terms of independent third-party websites.
Customers should review the applicable terms and policies of those providers before using their services.
20. PERSONAL INFORMATIONPersonal information submitted through our website will be handled in accordance with our Privacy Policy and applicable data protection requirements.

21. WEBSITE INFORMATIONWe make reasonable efforts to ensure that product descriptions, pricing, delivery information and other website information are accurate.
Occasionally, information may contain typographical errors, inaccuracies or omissions.
We reserve the right to correct errors, update information or amend product descriptions where reasonably necessary.
We may also update, change or discontinue products or website features without prior notice.
22. PROHIBITED USESYou may not use our website or services:

Nothing in these Terms & Conditions excludes or limits any liability, consumer right, warranty or remedy that cannot legally be excluded or limited under applicable South African law.

INDEMNIFICATIONTo the extent permitted by applicable law, you agree to indemnify and hold harmless The Party Pop Pty Ltd, its directors, employees, contractors and service providers against claims arising directly from your unlawful use of our website, your breach of these Terms & Conditions, or your infringement of another party's rights.
25. SEVERABILITYIf any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as severed to the extent necessary.
The remaining provisions will continue to apply.
26. ENTIRE AGREEMENTThese Terms & Conditions, together with our Privacy Policy, Refund/Returns Policy, Shipping Policy and any other applicable policies displayed on our website, constitute the agreement governing your use of our website and purchases from The Party Pop.
27. CHANGES TO THESE TERMSWe may update these Terms & Conditions from time to time to reflect changes to our products, services, business practices or legal requirements.
The latest version will be published on this website.
Your continued use of our website after changes have been published constitutes acceptance of the updated Terms, to the extent permitted by law.
28. GOVERNING LAWThese Terms & Conditions and any separate agreements through which The Party Pop provides products or services are governed by the laws of the Republic of South Africa.
